How come there are new Dell Laptops for sale or Ebay? Are they the real deal?

I am considering purchasing a laptop from ebay and am particularly interested in the Dell XPS M1330 - is this a good laptop? I have seen some good offers of this model on ebay but wondered has anyone purchased a Dell through ebay as I thought that Dell only sold direct through their website. Therefore I want to know could these be real Dell laptops and are they safe to buy, obviously providing the seller has good feedback, etc. ?
perhaps they cant be sold as new because they are damaged cosmetically like a few scratches on the unit but otherwise ok...you can get goods like this in bulk
